Terms of Service

By using the Banished website, and/or the Banished Android tools, you agree to follow all the terms and conditions listed below. If you do not agree to these terms, you are strictly forbidden from using any of the Banished Services or Tools.

The Banished Discord Bot, Website, Android App, iOS shortcut, and any other Banished provided services fall under the terms of the Banished Tools.

Definitions

The terms "We", "Us", and "Our", "Banished" refer to Banished. The terms "you" and "your" refer to you, the user of the Banished Services.

The terms "Site", "Website" refers to the Banished website, located at https://banished.app.

The terms "Android App" refers to the Banished Android App or the Banished Android Tools.

The terms "iOS Shortcut" refers to the Banished iOS Shortcut.

The terms "Services" refers to the Banished website, the Banished Android App, the Banished iOS Shortcut, and any other Banished provided services.

The terms "User", "Users" refers to the users of the Services.

The terms "Desktop App" refers to the Banished Desktop App.

The terms "Discord Bot", "Bot" and refers to the Banished Discord Bot.

The terms "Tools", "Banished Tools" refers to the tools provided by Banished on the Desktop App, Android App, Website, or iOS shortcut, including but not limited to the Pack Porter, the Pack Creator, and the Cape Replacer.

1. Usage of the Tools

By using the Tools, you are agreeing to being 13 years of age or older. If you are under the age of 13, you are not allowed to use the Tools.

You agree that you will not attempt to reverse-engineer, decompile, or disassemble any part of the Tools.

You agree that you will not use the Tools for any illegal or unauthorized purpose.

You agree that you will not use the Tools in any way which is prohibited by these terms.

You agree that you will not use the Tools for any commercial, business, resale, other profit-making, or non-profit purposes, or for any purpose other than personal use, unless you have been granted permission by Banished.

2. User Content

By using the Tools, you agree that you are responsible for any content you upload to the Tools. You agree that you will not upload any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

You agree that you will not upload any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

You agree that you will not upload any content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

3. Limitation of Liability

You agree that Banished will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the Tools.

4. Changes to the Terms

Banished reserves the right to change these terms at any time. You are responsible for reviewing these terms regularly. Your continued use of the Tools after any changes to these terms will be considered acceptance of those changes.

5. Termination

Banished reserves the right to terminate your access to the site at any time, without notice, for any reason whatsoever.

All provisions of these terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If you are found to be in violation of these terms, Banished reserves the right to terminate your access to the Tools, without notice, without refund and without the ability to appeal.

If you wish to terminate your access to the site, you may do so by discontinuing your use of the Tools.

6. Indemnification

You agree to indemnify and hold harmless Banished, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Tools, including but not limited to your violation of these terms.

If you are found to be in violation of these terms, Banished reserves the right to take legal action against you, including but not limited to seeking monetary damages, injunctive relief, and criminal prosecution.

7. Warranty Disclaimer

The Tools are provided "as is" and "as available" without any warranty of any kind, either express or implied. Banished does not warrant that the Tools will be available at all times or that they will be free from errors or defects.

Banished does not warrant that the Tools will meet your requirements or that the Tools will be uninterrupted, timely, secure, or error-free.

You understand and agree that any material or data downloaded or otherwise obtained through the use of the Tools is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material or data.

No advice or information, whether oral or written, obtained by you from Banished or through or from the Tools shall create any warranty not expressly stated in these terms.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, and the laws of Germany, the host country of the Banished Website.

9. License

By using the Tools, you agree to the terms of the license agreement provided by Banished.
